Robertson V J Sidney Smith

Robertson_v_J_Sidney_SmithTwo cyclists were cycling in single file along an A road.

They were travelling in a coned off section of the road.

When that section came to an end, they made to come back onto the road where there was traffic.

However, a bus had moved out to pass the cyclists.

The bus was followed by a Mercedes van being driven by the Defender and this vehicle was travelling too close to the bus in front.

The Defender tried to swerve out of the way but his nearside wing mirror collided with the cyclist.

The cyclist came off his bike and suffered severe injuries.

Van driver 100% to blame
